Yesterday, the U.S. Consumer Product Safety Commission voted unanimously to issue a one year stay of enforcement for certain testing and certification requirements for manufacturers and importers of regulated products, including products intended for children 12 years old and younger.  Basically this means we now have until February 10, 2010 to comply with the new law.  In the meantime, the decision by the Commission gives the staff more time to finalize four proposed rules which could relieve certain materials and products from lead testing and to issue more guidance on when testing is required and how it is to be conducted.

So what does this all mean for us at FluffyMail.com?  Well, it means we will stay open for another year at least!  We will be following the news in regards to the CPSIA over the next year and will continue to work towards compliance if at all possible.  Please be assured that there are no parts to our diapers (fabrics, labels, thread, elastic, or snaps) that contain lead.

For those of you who have already ordered from our inventory sale we are working hard to get your orders sewn up and shipped out as fast as we can.  Those of you who are still on the wait list, we will of course honor the sale for anyone who emailed us with interest.  There is still a lot to choose from on the inventory list and it is not everyday that you can get up to 30% off our diapers!  We have closed the wait list and will be contacting those of you still waiting in the next 2 weeks.

Thank you so much to everyone who signed petitions and contacted their local and state politicians to express their thoughts on this new law.   There is no question that it was your action that is letting us continue sewing diapers for another year.  We are so very grateful to you all.

We wanted to take a minute to inform our customers about the future of FluffyMail.com.  As most of you know, we have been in business since 2003 manufacturing and selling handmade cloth diapers and diapering products.  We love our business, our products, and our customers and are sad to say that the future of FluffyMail.com is unknown.

On October 18, 2008, President Bush signed into law new legislation called the Consumer Product Safety Improvement Act (CPSIA) as a direct response to the high levels of lead found in some of the children’s toys manufactured overseas.  A deadline was set for February 10, 2009 for all businesses manufacturing and selling items made for children under the age of 12 to become compliant with the new law.  Compliance under this law requires batches of manufactured children’s items sold in the US to be tested for lead and phthalates.  This testing is very expensive and is not an option for us.  As of February 10, 2009, non-compliant goods will be treated as Hazardous Materials and can not be sold.  The civil penalty caps have been increased from $5,000 to $100,000 for each violation.

What does this mean for FluffyMail.com?  Unless the law is changed to be less broad and protect small WAHMs businesses we will not be able to sell our products after February 10th.  In the meantime, we have a lot of inventory sitting around that we need to move out before that date.  If you are interested in purchasing some of our current inventory you can email us at sales@fluffymail.com and we will start a first come/first served list.  These items will be semi-custom items only, not full customs.  We have a lot of diapers already cut out and ready to be sewn up including print fitteds and PUL AIOs in all sizes and styles as well as some Night Lights.  We are working on taking an accurate inventory to show what we have available and will work through the wait list as quickly as possible before the February 10th deadline.
